2. TYPES OF DATA COLLECTED AND PURPOSES OF PROCESSING
The website collects personal data necessary for the management of the tourism and hospitality services offered, cataloged as follows:
- Data entered in the Contact Form (Request form): Personal and contact data (Name, Email, Phone Number, Message) voluntarily entered by the user are collected. The purpose is to handle requests for information or availability for our suites.
- Booking Data (Octorate Booking Engine): For the management of direct bookings, the site redirects the user to or integrates with the external platform Octorate. The data entered during the booking process (including payment data) are processed for contractual and fiscal purposes related to the stay.
- Navigation data: The computer systems and software procedures used to operate this website acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols (e.g., IP addresses, browser type).
Legal basis of processing: Data processing is based on the execution of pre-contractual or contractual measures (Art. 6, par. 1, lett. b of the GDPR) related to the request or booking of the stay, as well as on compliance with legal obligations.
3. LEGAL OBLIGATIONS FOR ACCOMMODATION PROPERTIES
Users are informed that in the event of an actual booking and subsequent stay at our property, the Controller is required by law to collect the identity data of guests and communicate them within 24 hours of arrival to the Public Safety authorities through the ministerial portal Alloggiati Web (TULPS – Art. 109). Such data will not be kept in digital or paper format beyond the time necessary for electronic transmission.
4. DATA RETENTION PERIOD
Data sent via request forms will be kept for the time strictly necessary to reply to the user (maximum 12 months if no booking follows). Data relating to successful bookings will be kept for 10 years, in compliance with current tax and civil obligations for companies in Italy.
5. DATA RECIPIENTS AND TRANSFER ABROAD
The personal data collected will not be distributed or sold to third parties. They may be communicated exclusively to subjects authorized by the Controller (e.g., administrative staff, tax consultants) or to technical service providers appointed as Data Processors (such as the Octorate booking platform). Data are stored on servers located within the European Union.
6. RIGHTS OF THE DATA SUBJECT
At any time, the user can exercise the rights provided by articles 15-22 of the GDPR, including the right to access their data, request their rectification, erasure (right to be forgotten), restriction of processing, or opposition to their use. Requests must be sent via email to: info@iltorchio.net. The user also has the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali).
